What’s new from the OFCCP?

Well a lot. So much has happened that I will skip my usual lengthy yet insightful prose for short, sweet and to the point. Enjoy!

Disability Self-Identification Video: “Disability Inclusion
Starts With You”
The OFCCP has released a video encouraging employees and applicants with disabilities to self-identify and understand “the important role that self-identifying plays in ensuring equal employment opportunity for people with disabilities.”  “Be counted, be included, self-identify.”  Learn more here.

Pay Transparency
The Office of Federal Contract Compliance Programs (OFCCP) issued a final rule implementing Executive Order 13665 promoting pay transparency that will take effect January 11, 2016.  The rule prohibits federal contractors and subcontractor from discriminating against employees and job applicants who inquire about, discuss or disclose compensation information.

To read more about your requirements and defenses under this new rule head to the OFCCP’s website which includes training webinars, FAQs, Nondiscrimination Provision, and the Final Rule.  Learn more here.

“EEO is the Law” Poster Supplement
When the OFCCP issued the final rule promoting pay transparency they also issued a mandatory supplement to the “EEO is the Law” poster which incorporates the changes to EO 11246 in which sexual orientation and gender identity became protected classes along with the pay secrecy clause. Learn more here.

Class Member Locator
The OFCCP has launched a website designed to locate employees and applicants who may be class members of existing Conciliation Agreements (CA).  The site has a video, FAQs and details on recent Conciliation Agreements in an easy online format.  Viewers of the video are asked to review the class member database and contact OFCCP if they may be part of an affected class.

By the way, there is no negotiating your way out of your company’s CA, that includes financial remedies for discrimination, being published on this website.  So signer beware. Lean more here.

Infographic: Am I A Protected Veteran?
OFCCP seeks to answer contractors, employees and applicants question as to who is a protected veteran under Vietnam Era Veterans Readjustment Assistance Act (VEVRAA), as amended (38 U.S.C. Section 4212).   Be sure to check out the new interpretation of Active Duty Wartime or Campaign Badge Veteran.  Now includes period of war vs. during a war.  Learn more here.

Infographic: Jurisdictional Thresholds
Did you know there are different thresholds of coverage for affirmative action coverage?  It is based on both your number of employees and dollar amount of your contract.  If you are a small federal contractor/subcontractor or are considering contracting with the federal government keep these thresholds in mind. Learn more here.

Reasonable Accommodations Pocket Card
OFCCP posted on its website a pocket card that put the process for understanding the reasonable accommodation process in simple language.  It answers these four questions:

  • What is a reasonable accommodation?
  • How do I request a reasonable accommodation?
  • What do I need to tell my employer?
  • What happens after the request is made?

Learn more here.
